The EUCart website and apps (the Platform) are run by EUCART LTD, company number 17455065, registered in England and Wales, registered office 30a Atlantic Close, Southampton SO14 3TA. Email: [email protected].
1. Who you buy from
1.1 EUCart is a marketplace. Your goods are sold to you by the shop named on the product page and at checkout, not by EUCart. The shop’s legal name and address are shown before you pay and on your receipt. Your contract for the goods is with that shop.
1.2 EUCart acts as the shop’s agent to take your order and payment.
1.3 Delivery is EUCart’s service to you, through our courier partner(s). The delivery fee is shown before you pay. At checkout you ask us to start delivery straight away and confirm that, once delivery is complete, you can no longer cancel the delivery service. This does not affect your right to cancel eligible goods under clause 8.3, and we refund delivery charges where the law requires. If the shop offers click & collect, you can collect your order from the shop instead, with no delivery fee.
2. Your account
You must be 18 or over. Keep your login safe and tell us about any unauthorised use.
3. Prices and payment
3.1 Shops set their prices, including VAT where applicable.
3.2 The checkout total includes every compulsory charge (goods, delivery and any service fee).
3.3 You pay by card through Stripe. Payment for goods is taken by EUCart on the shop’s behalf, and paying EUCart settles your payment to the shop. Your goods receipt is issued in the shop’s name, with its VAT number on any VAT invoice if it is VAT-registered. EUCart’s delivery and service fees are shown separately in EUCart’s name.
4. Orders
4.1 Your contract with the shop is made when we confirm your order at payment, on the shop’s behalf. The shop then confirms it can prepare your order. If it can’t, or doesn’t confirm within 12 minutes (or at least 30 minutes before your delivery slot for scheduled orders), we cancel the order and refund you in full, including delivery. We will notify you.
4.2 Unavailable items are removed from your order and refunded; we don’t substitute them. If nothing can be supplied, the order is cancelled and fully refunded, including delivery.
4.3 Fresh and weighed products may vary slightly from the photo or stated weight.
4.4 We may cancel your order if there are reasonable grounds to suspect fraud, or if a displayed price is obviously wrong, where the law permits. We will tell you and promptly refund all charges, including delivery. You can challenge a cancellation by emailing [email protected].
5. Allergens and product information
5.1 Product and allergen information comes from the shop and is shown in English on each product page. Check it before you buy and on delivery.
5.2 If you have an allergy or a question, contact the shop through the Platform or email us before ordering.
6. Alcohol
6.1 Alcohol is sold only to people aged 18 or over. By ordering it you confirm you are 18 or over.
6.2 The courier (or the shop, for click & collect orders) asks for photo ID from anyone who looks under 25, and will not hand over alcohol to anyone under 18, intoxicated, without valid ID, or where a proxy purchase is suspected.
6.3 If alcohol is lawfully refused for one of these reasons, it is returned to the shop and its price refunded. We may keep the delivery fee for a reasonable delivery attempt. If we or the courier caused the failure, we also refund the delivery fee.
7. Delivery
7.1 Delivery times are estimates. We will tell you about delays.
7.2 Someone must be available during the delivery window. The courier will follow your instructions and try to contact you.
7.3 If delivery fails only because you were unavailable:
- returned goods that can be resold are refunded;
- for perishable goods that cannot be resold, the shop may deduct its reasonable, evidenced loss, up to their price, after allowing for any value recovered;
- we may keep the delivery fee for a reasonable attempt;
- any redelivery charge needs your agreement first.
No deduction applies if the shop, EUCart or the courier caused the failure.
7.4 Check your order on delivery.
8. Problems, refunds and cancellations
8.1 Please report a problem (a missing, damaged, wrong, out-of-date or unsafe item) as soon as possible, ideally within 48 hours, through the app or by email, with a photo where possible. We arrange a refund or replacement on the shop’s behalf where the problem is confirmed. Reporting later does not affect your legal rights.
8.2 Goods must be as described, of satisfactory quality and fit for purpose under the Consumer Rights Act 2015.
8.3 Cancellation: you can cancel free of charge until the shop starts preparing your order. For other goods covered by the statutory 14-day cancellation right, you can cancel before delivery and up to 14 days after delivery. That right does not apply to goods liable to deteriorate or expire rapidly, or to sealed goods unsuitable for return for health or hygiene reasons if unsealed after delivery. You pay return costs unless the goods are faulty. You may be liable for any reduction in value caused by handling the goods more than necessary to check them.
To cancel, tell us clearly in the app or by email and return eligible goods within 14 days of telling us. You may use: “I cancel my order [number], ordered [date], received [date], name and address [details].” Return the goods to the shop’s address, which we confirm when you cancel.
8.4 Refunds use your original payment method. For statutory cancellations we refund without undue delay and within 14 days of your notice. Where the law allows us to wait for returned goods, we refund without undue delay and within 14 days of receiving the goods back or evidence that you have sent them, whichever is earlier. We refund standard delivery charges where required by law. Other refunds are normally made within 14 days.
9. Reviews
Reviews must reflect your own order. We remove fake, paid, offensive or unlawful reviews.
10. Our responsibility
10.1 The shop is responsible for the goods and product information. EUCart is responsible for the Platform, for handling payment as the shop’s agent, and for delivery.
10.2 We are not liable for unforeseeable losses or business losses. Nothing limits liability for death or personal injury caused by negligence, fraud, or anything that cannot legally be limited.
11. Using the Platform
Don’t misuse the Platform or use it unlawfully. We may suspend accounts that are misused.
12. Complaints
Email [email protected]. We acknowledge within 2 working days and aim to resolve within 10 working days. When we reply with our decision, we tell you about any dispute resolution option available. You may also bring a claim in the courts.
13. General
13.1 We may update these terms. The version in force when you order applies to that order.
13.2 English law applies. If you live in Scotland or Northern Ireland, you may also use your local courts.
